Votes to convict

Sixty-seven to remove.

Two-thirds of the senators present removes a President and a Vice President. The same two-thirds removes Pete Hegseth, Robert F. Kennedy Jr. or Florida’s Marco Rubio, confirmed 99 to 0 as Secretary of State, who also serves as national security adviser and is rumored to be resigning to consider a run for President, which he denies. But a Secretary who leaves or is removed is replaced by the same President. He chose who followed Kristi Noem and Pam Bondi this year, and an acting official he picks can hold the job for 210 days, and longer while nominations are pending. Three days after the election he made Stephen Miller his chief of staff, a post the Senate does not confirm. Removing the people below the top changes who carries out the orders and leaves alone who gives them, and every route through this comes back to who is President.

Remove only the President and the Vice President takes over. Remove both and the next in line by law is the Speaker of the House. That is why the President and the Vice President come first.

Forty-seven Democrats sit today. The eighteen Republicans whose own seats are on the ballot in 2028 are counted on the sheet, and thirteen more leave in January with no election in front of them.

Where it standsAt least five resolutions to impeach the President alone are on file in this Congress. None we found names the Vice President. Six articles against Pete Hegseth from Yassamin Ansari have been on file since April 15, and Thomas Massie, a Republican, says he will reintroduce his eight and force action the week of November 9 unless Hegseth resigns. The House can vote on them or table them. Sherrod Brown could be seated in Ohio’s seat as early as December 15. Alaska and Mississippi are uncalled.

If the House sends articles against the President and the Vice President, will you vote to convict, vote to acquit, or decline to say?

The eighteen up in 2028

What each senator’s state did on Tuesday, in the order chosen above. The margin is the top statewide race: U.S. Senate where one was on the ballot, otherwise governor, otherwise the closest statewide office. The swing compares that race with the 2024 presidential margin. The candidates differ, and in Indiana, Missouri and North Dakota the race is for a lower office.

The rule

The House impeaches by a majority. The Senate convicts by two-thirds of the senators present, which is sixty-seven when all hundred sit and sixty when ninety do. The Constitution names “the President, Vice President and all civil Officers of the United States,” so a Secretary of Defense, a Secretary of Health and a President are tried by the same jury to the same number. A senator who stays away lowers it, and the sheet above moves with it.

The clock

Once the House presents articles, the Senate’s rules have it take them up at one o’clock the next day and sit every day but Sunday until judgment. A majority can change that. In April 2024 a majority of 51 dismissed the articles against Homeland Security Secretary Alejandro Mayorkas the day after they arrived, with no trial. Articles adopted by one Congress were tried in the next in 1999 and 2021, and the 2021 trial took place after the President had left office.

The two Senates

Before January 3 the jurors are the ones who sit today, thirteen of them leaving and two with races not yet called, and Republicans hold the majority that sets the trial’s rules. From January 3 that majority belongs to the Democrats. With every senator present, conviction then takes thirteen Republicans, or eleven if Democrats win Alaska and Mississippi. The case for doing it in both, and the route through the Speaker’s chair, is at Call the question.
